The Office of Licensing and Enforcement
is responsible for the implementation and enforcement of various
codes, ordinances and licensing regulations adopted by the Board
of Garrett County Commissioners, including the Transient Vacation
Rental Unit Ordinance, Junkyard Ordinance, Livability Code, Mobile
Home Park Tax, Special Event Licensing and other property maintenance
codes.
A brief description of the items most inquired about:
Transient Vacation Rental Units
The Garrett County Planning Commission and a committee
of citizens of the County prepared an Ordinance for the purpose
of regulating and licensing the use of residential property that
is offered for rent and rented on a transient or short-term basis. On March 1, 2006 the Ordinance was enacted by the County Commissioners to regulate the use of a residential home as Transient Vacation Rental Unit. This office works in concert with the Department of Environmental Health to regulate the Ordinance.For information about the Department of Environmental Health, please click here. Livability Rental Code Enforcement
This ordinance deals with long-term rental properties. The landlord
is responsible for conditions of the property and must provide
certain minimum requirements. This division is charged with enforcement
of this ordinance.

Junkyard Licenses
This ordinance
deals with licensing of established junkyards and the enforcement
of junkyard violations. Anyone storing or keeping junk occupying
an area of 1,000 square feet within visual sight of any public
roadway must obtain a license. This includes junked and partially dismantled vehicles.

Unsafe Structure Enforcement
Provides a process to identify, address and abate a dangerous structure that contains unsafe equipment or is damaged, decayed, dilapidated, structurally unsafe, or of such faulty construction or unstable foundation that a partial or complete collapse is possible and presents a threat to the health, safety, and general welfare of the community.

Accomodation Tax Enforcement
The Garrett County Office of Licensing and Enforcement has been designated by the County Commissioners as the entity to enforce non-compliance of the accommodation tax regulations. Maryland law provides that the accommodation tax collected for the County is to be held in trust until the hotel pays the tax as required (Md. Code Art. 24 § 9-309). Maryland law also prohibits the fraudulent intent to use money contrary to the requirements of the fiduciary’s trust responsibility (Md. Criminal Law § 7-113).In other words, the accommodations tax collected for the County and it must be accounted for separately. The use of this money for anything other than the monthly payment of taxes to the County is strictly prohibited by law.
