APPLICATION PROCESS
Until a zoning permit has been secured from the Zoning Administrator, no
structure (except certain signs as provided in Article 7 of the Mountain Lake
Park Zoning Ordinance) shall be erected, constructed, reconstructed, or
moved; and no land or building used or occupied; and no land or building
changed in use. All applications for zoning permits shall be made in writing by
the owner, tenant, vendee under contract of sale, or authorized agent on a
form supplied by the Zoning Administrator. The application shall include the
following, except where the Zoning Administrator determines such information
is not necessary to determine compliance with the Mountain Lake Park Zoning
Ordinance.
A. A statement as to the proposed use of the building or land.
B. A site layout drawn to scale showing the location, dimensions, and height
of
proposed buildings, structures, or uses,
and any existing buildings in relation
to
property and street lines.
C. Lot dimensions, lot and block numbers, and subdivision name, if any.
D. The location, dimensions, and arrangement of all open space, parking
areas,
and yards. Methods to be used for
screening shall be included where
applicable.
E. The number, location, and design of parking areas if applicable.
F. The dimensions, location, and methods of illumination for signs, if
applicable.
G. In the case of applications for interpretations, variances, and special
exceptions, the additional information specified
in Section 1010 of the
Mountain Lake Park Zoning Ordinance.
H. Any other information deemed necessary by the Zoning Administrator to
ascertain whether an application complies
with the provisions of the Mountain
Lake Park Zoning Ordinance.
APPEALS FOR VARIANCES AND SPECIAL EXCEPTIONS
Upon denial of a zoning application by the Zoning Administrator, the applicant
may file an appeal with the Mountain Lake Park Board of Zoning Appeals. A Variance is a request to vary or modify the strict application of certain
specific requirements of the Mountain Lake Park Zoning Ordinance in the
case of exceptionally irregular, narrow, shallow or steep lots, or other
exceptional physical conditions whereby such strict application would result in
practical difficulty or unnecessary hardship depriving the owner of the
reasonable use of land or building involved. A Special Exception is a request
for a particular use of property which is listed in the Mountain Lake Park
Zoning Ordinance as permitted only by special exception granted by the
Board of Zoning Appeals.
All appeals shall be made by filing the same with the Zoning Administrator
within 30 days after the date of the Zoning Administrator's original decision.
Appeals for variance from the strict application of the Mountain Lake Park
Zoning Ordinance shall include the zoning permit application denied by the
Zoning Administrator together with a statement with any supporting data
regarding the requirements listed in Section 1005 of the Mountain Lake Park
Zoning Ordinance. Applications for special exceptions shall include a zoning
permit application with all information required therein and a statement with
any supporting data regarding the merits of the proposed use at the proposed
location and how the proposal complies with the general and specific
requirements of the Mountain Lake Park Zoning Ordinance.
Upon filing with the Board of an application for a special exception or
variance, the Board shall fix a reasonable time (not less than 14 days nor more
than 45 days from the filing date) for a public hearing thereon.
FEES
All applicants for zoning permits, special exceptions, and variance appeals
shall at the time of making application, pay to the Town for the use of the
Town, a fee in accordance with the fee schedule which may be adopted and
amended by resolution of the Town Council. In addition, the applicant shall be
responsible to pay any other actual expenses incurred by the Town through
the County Planning and Zoning Office.
BOARD OF ZONING APPEALS
The Board consists of three (3) members. The terms of office of the members
is three (3) years. Members are appointed by the Mayor and confirmed by
the Town Council. The current Board members are as follows:
